General Terms and Conditions of Sale

1. Seller identification
These general terms and conditions of sale are concluded between the Customer and Laboratorio Europeo Medico S.L., a limited liability company, established at CL CERVANTES 14, CEUTA 51001 Spain, VAT number B75962837, email info@Labeuromed.eu, establishment authorisation.
The website Labeuromed.eu is published by Laboratorio Europeo Medico S.L. and hosted by Vercel Inc., a company incorporated under the laws of Delaware (USA), 440 N Barranca Ave #4133, Covina, CA 91723, United States, support@vercel.com.
Any request relating to an order, complaint, warranty, return, withdrawal or product recall may be addressed to info@Labeuromed.eu or by post to the registered office indicated above.
2. Scope of application
These general terms and conditions apply to any order for Products placed on the website Labeuromed.eu, by phone, by email, by purchase order or by any other means accepted by Laboratorio Europeo Medico S.L..
They apply to sales concluded with Consumers and with Professionals. In the event of a conflict between the common clauses and the specific clauses applicable to Consumers, the B2C clauses shall prevail. Mandatory rights recognised to Consumers may not be excluded or limited by these general terms and conditions.
Any order implies prior, express and unconditional acceptance of these general terms and conditions in the version applicable at the date of order confirmation. The general terms and conditions of the professional Customer, including its purchasing conditions, are excluded unless expressly, previously and in writing accepted by Laboratorio Europeo Medico S.L..
The Customer acknowledges having read these general terms and conditions of sale and declares, by placing the order, that they expressly accept them without reservation. Confirmation of the order and payment thereof constitutes acceptance of the general terms and conditions of sale.
3. Definitions
- Customer: any natural or legal person placing an order for Products with Laboratorio Europeo Medico S.L..
- Consumer: any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft or liberal professional activity.
- Professional: any natural or legal person acting for purposes that fall within the scope of their commercial, industrial, craft or liberal professional activity.
- Products: the food supplements and other products offered for sale by Laboratorio Europeo Medico S.L..
- Order: any request to purchase Products made by the Customer and accepted by Laboratorio Europeo Medico S.L. in accordance with the procedures set out in these general terms and conditions.
- Website: the website of Laboratorio Europeo Medico S.L. on which the products are presented and sold to customers.
- Transaction: a set of operations, secure processing, authorisations and agreements relating to the payment of products ordered by credit card or any other virtual transaction method offered on the Website.
4. Nature of the Products
The Products marketed by Laboratorio Europeo Medico S.L. are food supplements. They are foodstuffs intended to supplement a normal diet and are a concentrated source of nutrients or other substances with a nutritional or physiological effect.
The Products are not medicines. They are not intended to diagnose, treat, cure or prevent any disease. They do not replace a varied and balanced diet, a healthy lifestyle or medical advice when such advice is necessary.
The Customer undertakes to comply with the conditions of use, recommended daily doses, warnings, contraindications, storage conditions and durability or consumption dates shown on the labelling, leaflet, product sheet or packaging.
In the event of pregnancy, breastfeeding, medical treatment, known medical condition, allergy, intolerance, doubt regarding an interaction or use by a vulnerable person, the Customer is invited to seek the prior opinion of a healthcare professional.
5. Pre-contractual information
Before any order, the Customer receives, in a legible and comprehensible manner, the essential information relating to the Products and the sale, including the essential characteristics of the Products, their composition, quantity, format, precautions for use, total price, delivery charges, payment methods, delivery restrictions, delivery times, the right of withdrawal where it exists, any exclusions thereof, applicable legal warranties and the seller's contact details.
The Customer is required to read the information on the product sheets, leaflets, labelling and these general terms and conditions before confirming their order.
Photographs, illustrations and representations of the Products are provided for indicative purposes only, unless expressly stated to have a contractual character.
6. Order
The Customer selects the Products they wish to order, checks the details of their order, its total price, their contact details, delivery address, billing address and payment method, then confirms their order in accordance with the process provided on the Website or by the ordering method used.
Before final confirmation, the Customer may identify and correct any input errors. The Customer is solely responsible for the accuracy of the information they provide, including their contact details, addresses and information necessary for the execution of the order.
When the order is placed online by a Consumer, the final confirmation button clearly and unambiguously states that the order entails an obligation to pay.
All information provided by the Customer when entering the data relating to their order is binding on them. Laboratorio Europeo Medico S.L. cannot under any circumstances be held liable for errors made by the Customer in the details of the recipient of the order (delivery address, billing address in particular) and for any resulting delivery delays or impossibility of delivering the ordered products.
The order is definitively accepted by Laboratorio Europeo Medico S.L. only after payment confirmation, except in the case of deferred payment, payment on delivery or any other method expressly accepted by Laboratorio Europeo Medico S.L.. A confirmation email summarising the order is sent to the Customer.
Laboratorio Europeo Medico S.L. may refuse, suspend or cancel any order on legitimate grounds, including fraud or attempted fraud, suspicion of abusive use, payment issues relating to the order concerned, a dispute regarding payment of a previous order, an abnormal order, an order manifestly intended for unauthorised resale, unavailability of the Product, a manifest pricing error, a regulatory restriction or a logistical difficulty related to the delivery country.
7. Product availability
Product offers are valid while they are visible on the Website, subject to available stock and absent any manifest error.
In the event of total or partial unavailability after order confirmation, Laboratorio Europeo Medico S.L. informs the Customer as soon as possible. The Customer may accept an extended delivery period, an equivalent replacement Product or the total or partial cancellation of the order.
In the event of cancellation due to unavailability, amounts paid in respect of the unavailable Product are refunded as soon as possible and, for the Consumer, in accordance with applicable legal time limits.
8. Prices
Prices are indicated in euros. For Consumers, prices are indicated inclusive of all taxes, excluding delivery charges and any other additional charges unless otherwise stated. For professional Customers, prices may be indicated exclusive of tax where this is expressly specified.
Delivery charges, taxes, duties or any other additional charges that may apply are indicated before final confirmation of the order where they can reasonably be calculated in advance.
Laboratorio Europeo Medico S.L. may modify its prices at any time. Products are invoiced on the basis of the prices displayed or accepted at the time the order is confirmed, subject to any manifest error.
9. Payment
The price is payable in full at the time of the order, except in the case of deferred payment, payment on delivery or any other method expressly accepted by Laboratorio Europeo Medico S.L..
The Customer warrants that they are authorised to use the chosen payment method. The order may be suspended or cancelled in the event of refusal of payment authorisation, non-payment, suspicion of fraud or an anomaly affecting the transaction.
Online payments are processed by a secure payment provider. Laboratorio Europeo Medico S.L. does not retain full credit card data, except as expressly provided for by the payment provider and accepted by the Customer.
10. Delivery
Products are delivered to the address indicated by the Customer at the time of the order, in the delivery countries offered by Laboratorio Europeo Medico S.L..
Delivery times are indicated before the order is confirmed. In the absence of a specific time indicated to the Consumer, Laboratorio Europeo Medico S.L. undertakes to have the ordered products dispatched to the Customer within an indicative period generally comprising:
- for Belgium: between 7 and 10 working days,
- for France: between 7 and 10 working days,
- for Luxembourg: between 8 and 11 working days.
Laboratorio Europeo Medico S.L. endeavours to meet the delivery times indicated in accordance with the standard logistical lead times in the industry. Laboratorio Europeo Medico S.L. cannot be held liable for delivery delays or failures resulting from the following events: technical issues, supplier failures, stock shortages, carrier failures, force majeure, unforeseen circumstances, inaccurate or missing information provided by the Customer, a delay requested by the Customer, non-payment or incomplete payment, delays related to customs formalities, repeated absence of the recipient, unjustified refusal to accept delivery, or an act attributable exclusively to the Customer.
In the event of a delivery delay attributable to Laboratorio Europeo Medico S.L., the Consumer may exercise the rights provided for by law. If the parcel is returned due to an incorrect or incomplete address, repeated absence or failure to collect attributable to the Customer, re-dispatch may be organised at the Customer's expense, subject to the mandatory rights of the Consumer.
11. Receipt and inspection of Products
Upon receipt, the Customer is invited to check the apparent condition of the parcel and the Products, the integrity of the packaging, seals, blisters, tamper-evident devices or security features, as well as the conformity of the Products delivered with the order.
Any apparent anomaly, including damaged parcel, missing Product, incorrect Product, opened packaging, altered seal, leakage, breakage, expired date or illegible batch number, must be reported to customer service as soon as possible, accompanied where possible by photographs, the invoice, the delivery note and the batch number.
This inspection does not deprive the Consumer of their legal rights, in particular under the legal warranty of conformity or hidden defects.
By placing an order, the Customer undertakes to pay, upon receipt of the goods, any taxes, duties, levies and other charges, present and future, due in connection with the delivery of the ordered products.
12. Transfer of risk
For Consumers, the risk of loss or damage to the Products is transferred to the Consumer at the moment when they, or a third party designated by them other than the carrier, physically takes possession of the Products, whether by direct handover, deposit or storage.
For professional Customers, unless otherwise agreed in writing, the transfer of risk occurs upon handover of the Products to the carrier or the first carrier responsible for dispatch. The Products travel at the professional Customer's own risk, except in the event of proven fault on the part of Laboratorio Europeo Medico S.L..
13. Consumer right of withdrawal
The Consumer has in principle a period of fourteen calendar days from the day on which they, or a third party other than the carrier and designated by them, physically takes possession of the Product, to exercise their right of withdrawal without having to give reasons. Where the order covers several Products delivered separately, the period runs from receipt of the last Product.
To exercise their right of withdrawal, the Consumer must notify their decision to Laboratorio Europeo Medico S.L. before the expiry of the period, by means of an unambiguous statement sent by email or post, or by means of the standard withdrawal form annexed to these general terms and conditions.
By way of exception, the right of withdrawal cannot be exercised for Products likely to deteriorate or expire rapidly, or for sealed Products that cannot be returned for reasons of health protection or hygiene and that have been unsealed after delivery.
In particular, opened, unsealed, partially used, used, damaged, incomplete Products, or Products whose protective packaging, seal, blister, tamper-evident cap, security feature or equivalent device has been altered after delivery are excluded from return. Returned food supplements must be unopened, unsealed, unused, complete, in their original intact packaging, with all accessories, leaflets, protective materials and security devices.
In the event of valid exercise of the right of withdrawal, the Consumer returns the Products concerned without undue delay and at the latest within fourteen days of notifying their decision. The direct cost of return is borne by the Consumer, unless Laboratorio Europeo Medico S.L. indicates otherwise or has failed to provide prior information about these costs.
Laboratorio Europeo Medico S.L. refunds the Consumer all payments received in respect of the Products subject to the withdrawal, including the initial standard delivery charges, excluding any additional charges resulting from the Consumer's choice of a more expensive delivery method than the standard method offered. The refund is made within fourteen days of receipt of the withdrawal decision. Laboratorio Europeo Medico S.L. may defer the refund until the Products have been recovered or until proof of dispatch has been provided, whichever occurs first. No flat-rate refund fee will be charged to the Consumer.
13bis. Online withdrawal function
Where the Customer is a Consumer and the order was concluded through the online interface of the website, Laboratorio Europeo Medico S.L. makes available to them, at the latest from the date on which the applicable legal provisions enter into force, an online withdrawal function enabling the right of withdrawal to be exercised in a simple, clear and accessible manner.
This function may take the form of a clearly identified button or link, in particular bearing the wording "Withdraw from my order", "Exercise my right of withdrawal" or any equivalent unambiguous formulation.
The withdrawal function is accessible throughout the legal withdrawal period, subject to the exceptions applicable to the Products, in particular where the Products are likely to deteriorate or expire rapidly, or where they are sealed Products that cannot be returned for reasons of health protection or hygiene and have been unsealed after delivery.
After activating the withdrawal function, the Consumer is invited to confirm or complete the information necessary for processing their request, including their identity, email address, order reference, the Product or Products concerned and, where applicable, the collection or return address.
When the withdrawal request is validly submitted through this function, Laboratorio Europeo Medico S.L. sends the Consumer without delay an acknowledgement of receipt of the withdrawal on a durable medium, including by email, stating the date and time at which the request was registered.
Use of the online withdrawal function does not deprive the Consumer of the possibility of exercising their right of withdrawal by any other legally permitted means, including the standard withdrawal form or an unambiguous statement.
14. No right of withdrawal for professional Customers
Professional Customers do not benefit from the right of withdrawal provided for Consumers, unless otherwise agreed in writing by Laboratorio Europeo Medico S.L..
Any order placed by a professional Customer is firm and final upon acceptance. No return, exchange or refund will be accepted without prior written agreement from Laboratorio Europeo Medico S.L..
15. Legal warranties applicable to Consumers
Consumers benefit from the legal warranty of conformity under the conditions provided for by applicable law. Laboratorio Europeo Medico S.L. is liable for defects of conformity existing at the time of delivery of the Product and appearing within the applicable legal period.
Given the nature of the Products, which are food supplements subject to storage conditions and a minimum durability date or a use-by date, conformity is assessed in particular with regard to the order placed, the product sheet, the declared composition, the labelling, the batch, the integrity of the packaging, the absence of opening or alteration prior to delivery, the date indicated on the Product and the normal conditions of transport and storage up to the point of delivery.
The legal warranty of conformity does not mean that the Product is guaranteed fit for consumption for two years regardless of its nature, minimum durability date, use-by date or storage conditions.
The Consumer also benefits, where applicable, from the warranty against hidden defects under the conditions provided for by applicable law.
Legal warranties do not cover defects or deterioration resulting from improper storage after delivery, exposure to heat, cold, humidity, light or any condition contrary to storage instructions, opening, handling or use of the Product after delivery, failure to comply with the recommended daily dose, use contrary to the warnings, contraindications or precautions for use, consumption after the date indicated on the packaging, or deterioration attributable to the Customer, a third party or an external event occurring after delivery. This clause does not limit the mandatory rights of the Consumer.
16. Complaints and warranties applicable to professional Customers
For professional Customers, any complaint relating to an apparent defect, delivery error, missing Product, damaged packaging or apparent non-conformity must be submitted in writing to Laboratorio Europeo Medico S.L. within five working days of receipt of the Products, accompanied by any useful supporting documentation.
In the absence of a complaint within this period, the Products are deemed accepted in respect of apparent defects, without prejudice to complaints relating to a duly proven hidden defect.
No return will be accepted without prior written agreement. Opened, unsealed, partially used, deteriorated or unsaleable Products will not be taken back or refunded, unless a defect attributable to the seller is duly established.
17. Dates, batches, storage and traceability
The Products bear a minimum durability date or, where applicable, a use-by date, as well as a batch number enabling their traceability.
The Customer is required to check this information upon receipt. Where Products are offered with a reduced remaining consumption period, this information is brought to the Customer's attention before the order is concluded.
Unless otherwise indicated, Products must be stored in a dry, temperate place, away from heat, humidity, direct light and out of reach of children.
No refund, replacement or credit will be due where the deterioration or impossibility of consumption results from inadequate storage after delivery, late consumption, exceeding the indicated date after storage by the Customer or failure to comply with the conditions of use, unless a defect existed at the time of delivery or liability is legally attributable to Laboratorio Europeo Medico S.L..
18. Product safety – withdrawal and recall
Laboratorio Europeo Medico S.L. implements the necessary measures to market Products that comply with applicable requirements in terms of food safety, traceability, consumer information and general product safety.
The Customer undertakes to retain, for a reasonable period after purchase, information relating to the Products, including batch number, invoice, delivery note and packaging.
In the event of a withdrawal, recall, safety alert, suspected defect or important information relating to a Product, Laboratorio Europeo Medico S.L. may contact the Customer by any appropriate means. The Customer undertakes to follow the instructions communicated, including ceasing use of the Product, retaining the Product concerned, returning or destroying it in accordance with the procedures indicated.
The professional Customer who resells the Products undertakes to ensure batch traceability, to retain the necessary information about their own customers where required by law, and to cooperate without delay with Laboratorio Europeo Medico S.L. in the event of a withdrawal, recall, inspection, alert or request from a competent authority.
19. Adverse effects and incidents
The Customer is invited to report without delay to Laboratorio Europeo Medico S.L. any adverse effect, incident, unusual reaction or suspected defect related to the use of a Product, indicating the Product concerned, the batch number, the date of purchase, the conditions of use and any other relevant information.
In the event of a serious adverse effect, the Customer must cease use of the Product and consult a healthcare professional or the relevant emergency services.
Laboratorio Europeo Medico S.L. may transmit the necessary information to the competent authorities, manufacturers, importers, insurers or relevant service providers, in compliance with applicable regulations.
20. Liability towards Consumers
Laboratorio Europeo Medico S.L. is liable to the Consumer for the proper performance of the contract under the conditions provided for by law.
No provision of these general terms and conditions may have the object or effect of excluding or limiting the legal rights of the Consumer, in particular under the legal warranty of conformity, hidden defects, product safety, liability for defective products, gross or wilful misconduct, or personal injury.
Laboratorio Europeo Medico S.L. cannot however be held liable for damage resulting from improper use of the Products, inadequate storage after delivery, exceeding the recommended doses, consumption after the indicated date, failure to comply with precautions for use, use despite a contraindication brought to the Customer's attention, or combination with medicines, treatments or other substances without professional advice where such advice is required.
21. Liability towards professional Customers
For professional Customers, Laboratorio Europeo Medico S.L. is only liable for direct, personal and certain damages resulting from a proven breach of its contractual obligations.
Except in cases of gross or wilful misconduct, personal injury, liability for defective products or a mandatory contrary provision, the total liability of Laboratorio Europeo Medico S.L. is limited to the amount excluding tax actually paid by the professional Customer in respect of the disputed order.
Laboratorio Europeo Medico S.L. will not be liable for loss of business, loss of turnover, loss of margin, loss of customers, reputational damage, data loss, withdrawal or recall costs attributable to the professional Customer, indirect or consequential damages, except where a mandatory contrary provision applies.
The professional Customer is solely responsible for resale, presentation, storage, promotion, the commercial claims they make, the information provided to their own customers and compliance with the regulations applicable to their business.
22. Resale of Products
Unless prior written agreement is obtained from Laboratorio Europeo Medico S.L., Products sold to Consumers are intended for personal use and may not be resold, distributed, transformed, repackaged, depackaged or used for commercial purposes.
Professional Customers may only resell the Products if such resale has been expressly accepted by Laboratorio Europeo Medico S.L. and subject to compliance with all applicable obligations, in particular regarding storage, traceability, food safety, consumer information, labelling, nutritional and health claims, advertising, data protection and cooperation in the event of withdrawal or recall.
Any unauthorised resale renders the professional Customer liable.
23. Retention of title
The Products remain the property of Laboratorio Europeo Medico S.L. until full payment of the price, including charges and taxes.
This retention of title clause does not affect the transfer of risk in accordance with the rules applicable to Consumers and Professionals set out in these general terms and conditions.
For professional Customers, in the event of total or partial non-payment, Laboratorio Europeo Medico S.L. may reclaim Products that have not yet been resold or transformed, without prejudice to any other action or claim for compensation.
24. Delivery restrictions and local regulations
Products are offered for sale only in the delivery countries indicated on the Website.
The Customer is informed that certain Products may be subject to specific rules depending on the delivery country, in particular regarding composition, labelling, importation, consumption, resale or advertising.
Laboratorio Europeo Medico S.L. may refuse, suspend or cancel an order where a regulatory, health, customs or logistical restriction prevents or makes delivery to the relevant country risky.
For professional Customers, it is the Customer's responsibility to verify that the purchase, importation, storage, promotion, resale or use of the Products complies with the regulations applicable in their own country or distribution market.
25. Force majeure
Neither Party may be held liable for a failure or delay in performance resulting from a force majeure event, understood as an event reasonably beyond the control of the affected Party, unforeseeable at the time the contract was concluded and whose effects cannot be avoided by appropriate measures.
Events that may constitute force majeure, depending on the circumstances, include natural disasters, fires, epidemics, administrative decisions, major transport disruptions, external labour disputes, war, major cyberattacks or widespread network failures.
The affected Party informs the other Party as soon as possible. Performance of the affected obligations is suspended for the duration of the event. If the impediment continues beyond sixty days, either Party may terminate the order concerned without compensation, subject to reimbursement of amounts owed to the Consumer in accordance with the law.
26. Personal data
The Customer's personal data is processed by Laboratorio Europeo Medico S.L. as data controller, in particular for the purposes of order management, payment, delivery, invoicing, customer service, complaints management, warranties, product withdrawals and recalls, compliance with legal obligations and, where applicable, commercial prospecting within the limits permitted by law.
The detailed terms of processing, legal bases, retention periods, recipients, any transfers, the rights of data subjects and the means of exercising those rights are described in the Privacy Policy available on the Website.
Where certain information is likely to reveal health-related data, in particular in the event of a personalised request, declaration of allergy, contraindication, medical treatment, adverse effect or health complaint, it is processed only under the conditions provided for by applicable personal data protection regulations.
27. Cookies and trackers
The Website may use cookies and similar technologies necessary for its operation, for audience measurement, for improving the user experience or, where applicable, for marketing purposes.
Non-strictly necessary cookies are only placed with the Customer's prior consent, where such consent is required. The Customer may configure their preferences at any time using the cookie management module available on the Website.

28. Intellectual property
All elements of the Website, including texts, trademarks, logos, trade names, photographs, illustrations, product sheets, graphics, videos, databases, structure, interface and content, are protected by applicable intellectual property rights.
Any reproduction, representation, adaptation, extraction, reuse, distribution or exploitation, in whole or in part, of the Website or its content, without prior written authorisation from Laboratorio Europeo Medico S.L. or the relevant rights holder, is prohibited.
The purchase of Products does not confer on the Customer any intellectual property rights over the trademarks, content or elements associated with the Products or the Website.
29. Complaints and customer service
Any complaint relating to an order may be addressed to the customer service team at the following address: georges.leglise@Labeuromed.eu.
The complaint must specify the order number, the Customer's identity, the Products concerned, the batch number where available, the nature of the problem encountered and any useful supporting documentation, including photographs, packaging, invoice or delivery note.
Laboratorio Europeo Medico S.L. endeavours to respond to complaints within a reasonable period. This amicable procedure does not deprive the Consumer of their legal rights.
30. Amicable dispute resolution and mediation
In the event of a dispute, the Customer is invited to contact Laboratorio Europeo Medico S.L. in advance in order to seek an amicable resolution.
The Consumer may have recourse to out-of-court dispute resolution mechanisms available under applicable law. The Parties remain free to accept or refuse the use of mediation, unless a mandatory contrary provision applies.
The former European online dispute resolution platform is not referenced as an active mechanism in these general terms and conditions if it is no longer operational at the date of publication of these terms.
31. Applicable law
These general terms and conditions and the contracts concluded with Laboratorio Europeo Medico S.L. are governed by Spanish law.
Where the Customer is a Consumer residing in another Member State of the European Union, the choice of Spanish law does not deprive them of the protection afforded by the mandatory provisions of the law of their country of habitual residence where those provisions are applicable.
32. Competent courts
For any dispute with a Consumer or a professional Customer relating to the validity, interpretation, performance, non-performance or termination of these general terms and conditions or an order, the competent courts of the jurisdiction in which Laboratorio Europeo Medico S.L.'s registered office is located shall have exclusive jurisdiction, notwithstanding multiple defendants, warranty claims, interim proceedings or urgent procedures, unless a mandatory contrary provision applies.
However, in the event of a dispute with a Consumer, the mandatory jurisdictional rules applicable in matters of consumer protection remain reserved. No provision of these general terms and conditions may deprive the Consumer of the right to bring proceedings before the competent courts under applicable mandatory rules.
33. Amendments to the general terms and conditions
Laboratorio Europeo Medico S.L. may amend these general terms and conditions at any time. The applicable conditions are those in force at the time the order is confirmed by the Customer. Any new version of the general terms and conditions applies only to orders placed after it has been published online, unless a contrary legal provision applies.
34. Evidence and archiving
Computer records, order confirmations, invoices, electronic exchanges and data retained in Laboratorio Europeo Medico S.L.'s systems or those of its service providers may constitute evidence of the order, payment, delivery and exchanges between the Parties, subject to the Consumer's right to provide proof to the contrary by any legally admissible means.
35. Partial invalidity
If any provision of these general terms and conditions is declared null, invalid, unfair, unenforceable or inapplicable, in whole or in part, the remaining provisions shall continue to apply in full.
The provision concerned shall be replaced, to the extent possible, by a valid provision producing an economic and legal effect as close as possible to the original intent, subject to the mandatory rights of the Consumer.
36. Annex – offline standard withdrawal form
